editAlthough this image is subject to copyright, I feel that the fair use provisions of U.S. copyright laws cover its use because:
- The purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes – The purpose of using this image is to profile a noted folk song collector of whom public images are rare. The use is for informational purposes in an encyclopedia article through a non-profit entity.
- The nature of the copyrighted work – The image was one found in the estate of the subject, connected with a ballad collection which was deeded to the special collections of Middlebury College, provided “that it should be used as a resource for academic and scholarly research.” The scanned image is of much lower resolution than the original (copies made from it will be of very inferior quality).
- The amount and substantiality of the portion used in relation to the copyrighted work as a whole – The image is but one of a large collection of artifacts from the Helen Hartness Flanders estate. Its original intent of the image was to publicize Flanders as a collector and author.
- The effect of the use upon the potential market for or value of the copyrighted work. – The imagery connected with the Helen Hartness Ballad Collection at Middlebury College are intended be used as a resource for academic and scholarly research, not as a source of profit. Images of Flanders have negligible market value.
