Image appears to have been first published "To Speak at Annual Conference Today". The Cornell Daily Sun. Ithaca, New York. 17 April 1937. p. 1 for which neither the masthead nor publishing information show a copyright. Searching further, found the e-bay image which is clearly marked as copyrighted. (The back side of the photo is dated to 1936) The US Copyright Law of 1909 allowed works to be copyrighted for 28 years, so checked renewals for 1964 Jan-Dec and find nothing for the author nor subject. Also checked renewals for 1965 Jan-Dec and find nothing for the subject. As a final step, checked copyright.gov for Kesslere, Kesslére as a claimant with no result and for Margaret Cuthbert as a title or name with no result.
Note that it may still be copyrighted in jurisdictions that do not apply the rule of the shorter term for US works (depending on the date of the author's death), such as Canada (70 years p.m.a.), Mainland China (50 years p.m.a., not Hong Kong or Macao), Germany (70 years p.m.a.), Mexico (100 years p.m.a.), Switzerland (70 years p.m.a.), and other countries with individual treaties.
