Although this publicity photo is presumably under copyright (although that is far from assured), inclusion here qualifies for Fair Use under US Copyright law because:
- It is used for a non-commercial and educational purpose.
- It is representative of Leonard Feather in a familiar but nonetheless important role.
- There is no public domain photo available of Jimmy Dorsey. He became famous well after 1923 and he died in 1994 (and so it is not possible to take a photo of him).
- This low-resolution jpg should not affect the commercial viability of the copyright.
