Different in Michigan?
edit(For what it's worth I just read this article verbatim on Answers.com) My reason for writing is to point out possible differences by jurisdiction. In Michigan Home Invasion is a crime but it is defined as entering a dwelling without permission to commit a crime regardless of whether it is occupied or not. Although- being occupied or having a weapon changes it from third degree to second or first. I learned this when I called my local paper to complain. An unoccupied home listed for sale was broken into on one day (it may have been vacant) and a man was shot on his steps the next. Both were headlined "home invasion". When I called to say their writing was wrong they said they only record what the police tell them. The reporter sent me the penal code and comments from the police providing the legal definition. I haven't seen anything to indicate whether or not Michigan is out of step with other jurisdictions other than articles like this one. This usage seriously waters down the term. - The Nevada citation, similarly, doesn't support the intro paragraph's assertion that the intended crime must be violent. Additionally, Nevada also does not require it to be "occupied", merely "inhabited" -- "A person who, by day or night, forcibly enters an inhabited dwelling without permission of the owner, resident or lawful occupant, whether or not a person is present at the time of the entry, is guilty of invasion of the home." --Rob* (talk) 09:40, 14 December 2018 (UTC)
Horrible Writing
editThis is HORRIBLY written! Please someone edit it, I can't even read it. Good try author, but please understand what encyclopedic means.
- You're right, it is indeed pretty terrible. I'm about to fix it. There's a lot of contradictions and dubious uncited remarks. I have changed the lede to reflect the necessary aspect of burglary; remember, burglary simply means illegally entering a private residence (either with or without force) for the purpose of committing some other crime. When that other crime is a violent crime against the occupant(s), it's a home invasion. Bravo Foxtrot (talk) 16:33, 31 March 2010 (UTC)

editOkay, I just had to rewrite this thing from the ground-up. One: These men have NOT BEEN CONVICTED OF ANYTHING. THey are only tried. To claim they sexually assaulted the daughters, stangled the mother, and set the house on fire is convicting them in the court of popular opinion. This is the sort of shit that would get someone fired in a newsroom. I'm posting a note here because I'm worried that I didn't do enough, or that the current wording is too weasel wordy. "Home invasion differs from burglary"
editIn New York State, at least, the crime of burglary is identical to this article's description of home invasion: trespassing with the intent to commit a crime such as robbery (or trespassing while in possession of an explosive). I'm not sure how other state or national laws differ, but I'd like to ask that more definitions be gathered and that the article's last intro paragraph be modified accordingly.
