info
editI made a revert to the page, as there was information inserted by User:Hmc3590 which didn't fit into a disambig page, it's copied pasted here. Maybe someone could put it into the Malice (legal term) article. - Hahnchen 05:57, 31 December 2005 (UTC)
- English case law referring is Dunlop; Bourgoin SA; Jones v Swansea City Council and Elguzouli-Daf v Commissioner of Police of the Metropolis [1995] 2 QB 335 at 346-347 per Steyn LJ. In this case the UK High Court found that malice could be made out if the act were done with an actual intention to cause injury. Malice could be shown if the act were done in the knowledge of invalidity or lack of power and with knowledge that it would cause or be likely to cause injury. Malice would also exist if the act were done with reckless indifference or deliberate blindness to that invalidity or lack of power and that likely injury. These elements, with respect, are consistent with the views of the majority albeit that some of those views were expressed tentatively having regard to the basis upon which the case before them was presented.

edit- The following is a closed discussion of a requested move. Please do not modify it. Subsequent comments should be made in a new section on the talk page. Editors desiring to contest the closing decision should consider a move review after discussing it on the closer's talk page. No further edits should be made to this discussion.
The result of the move request was: not moved. No consensus was reached on whether Malice (law) was the WP:PRIMARYTOPIC for this title. In addition, opponents to the move expressed concern that the legal term is narrower in scope than the everyday term, causing the balance of arguments to ultimately swing in favor of retaining the current titling situation. In my opinio it is the primary meaning. It has a huge number oof backlinks and I think it adds extra fork for editors in order to disambiguate. Lokys dar Vienas (talk) 19:42, 25 January 2023 (UTC)
- Support as the WP:PRIMARYTOPIC. Rreagan007 (talk) 19:57, 25 January 2023 (UTC)

- Hmm, there's a danger that the legal use of a term is always narrower than the general use. In ictu oculi (talk) 20:36, 25 January 2023 (UTC)
- Yes, I thought of it, but unfortunately now the general use is linked to "law" anyway, see eg Villain or Empathy. I dont think that in common parlance the term differs from its legal meaning much and the situation may be remedied by slightly editing the lede by throwing in a couple of dicdefs and then switching to legalese. - Hmm. WikiNav for the current list indicates that only 46 out of 396 clicks (~12%) went to the proposed primary topic, and it wasn't at the top of the list either (the '93 film is). Mass views for the current list indicates that Michael Malice, the aforementioned film and No Malice all have substantially more views generally compared to the legal concept. I wouldn't be so sure that this isn't an overreach in the direction of WP:DICDEF. --Joy (talk) 15:38, 26 January 2023 (UTC)
- Oppose per Joy's data: only a small fraction of readers seek this topic when they search for "Malice", so it's not the primary topic with respect to usage. Add to that concerns about the narrow scope of the legal concept as opposed to the everyday meaning, and the fact that the encyclopedia doesn't necessarily follow a dictionary hierarchy anyway... Also, only about a third of the links for "malice" appear to intend the legal concept [1]. – Uanfala (talk) 11:38, 28 January 2023 (UTC)
- Support, and slightly expand the article on the legal term to note that this is the legal sense of the general sense of having an ill intent. All of the popular culture topics, however popular they may be, are references to that sense. BD2412 T 02:13, 29 January 2023 (UTC)
- Oppose per WP:PRIMARYTOPIC (e.g. Malice (1993 film)); no editor as of yet has made a case for PRIMARY[encyclopedic]TOPIC and User:Joy's stats show the contrary. Re "I think it adds extra fork for editors in order to disambiguate", Wikipedia is optimized for readers, not editors. — AjaxSmack 04:24, 30 January 2023 (UTC)
