Image license question

edit

At File:Tatratea Logo.jpg, you wrote that the file is has a free license (creative-commons), and that "The license statement can be found online at: www.karloff.sk". I was unable to find it there. Could you provide a more specific link or instructions how to navigate through their website to find it? DMacks (talk) 00:53, 7 August 2012 (UTC)Reply

Hi DMacks, many thanks for highlighting this issue.

Actually the file was given to me by its owner (the company itself) because I had some difficulties to find the exact logo.

I asked them by email if they could provide me a picture of their own logo because I wanted to create a wikipedia article based on their product portfolio (I discovered it during the SIAL Exhibition in Paris) and they have kindly accepted my request.

Following this statement, I did not know what to tick in the subcategory license and I saw they had the copyright logo at the bottom of their webpage, so I thought it matched with what was expected by Wikipedia.

Was I right thinking that their approval was enough to use their logo in my article ? Many thanks for all your help in this matter.

Tatratea (talk)

Checking with the company is a great idea! Not many people think to simply ask a company or other article-subject for an image and permission to use it.
There are two separate issues: whether the image is usable in the article (which may or may not depend on the license) and what the license of it is (whether it's "free" or not). Licensing policy can be kind of confusing, so here is a bunch of information that at least resolves the main concern of yours and explains what (if any) additional information you might be able to provide to help clarify other details.
If the image has a free license, it can be used pretty much any way you like. But even if it's non-free, wikipedia still allows its use in very limited situations, one of which is a brand-logo in the infobox of an article specifically about that brand. That sort of use of a non-free image does not require any permission from the owner (it's a wikipedia policy that uses an explicit legal exception). So either way, the image is usable in this article.
The only concern is how to classify the license of the image itself. For copyright, the owner controls the use and permissions, so "all rights reserved" means you can do pretty much nothing (and that is the default even if they don't say it), "okay to use this on WP" means exactly that and no more, "Creative commons" is a specific copyright/license that entails a fairly broad range of allowable uses well beyond what a normal copyright would permit. It is one of several "free" licenses that allow reuse, editing, and even commercial redistribution by anyone anywhere. So unless they said "this image is creative-commons license" or "this image is from our website" (and the website explicitly says creative-commons) or comparable terms, it's not CC. I didn't see that on the website, so I was stuck making the safe assumption (to avoid breaking licensing laws) that it was not CC. On the other hand, if the company says "you may use this image on our Wikipedia article", it's definitely not free, because they didn't include all the permissions that are part of the "free" definition. Hi DMacks,

Apologies for such a late reply, I did not have so much time to check wikipedia these last days. Just to say you that I changed the logo after having received an email from the Marketing Department of tatratea saying the previous logo was just a visual effect but not the corporate one.

They still agree to broadcast the new one on Wikipedia even if I know (following your last message) that when the image is a brand-logo the owner's permission is not necessary.

I also followed your remarks and improved the classification of the logo by ticking non-free image. I just want to take this opportunity to thank you for all your time.

Cheers !

Conflict of interest

edit

Hello, Ice Hockey. We welcome your contributions to Wikipedia, but if you are affiliated with some of the people, places or things you have written about in the article Tatratea, you may have a conflict of interest or close connection to the subject.

All editors are required to comply with Wikipedia's neutral point of view content policy. People who are very close to a subject often have a distorted view of it, which may cause them to inadvertently edit in ways that make the article either too flattering or too disparaging. People with a close connection to a subject are not absolutely prohibited from editing about that subject, but they need to be especially careful about ensuring their edits are verified by reliable sources and writing with as little bias as possible.

If you are very close to a subject, here are some ways you can reduce the risk of problems:

  • Avoid or exercise great caution when editing or creating articles related to you, your organization, or its competitors, as well as projects and products they are involved with.
  • Be cautious about deletion discussions. Everyone is welcome to provide information about independent sources in deletion discussions, but avoid advocating for deletion of articles about your competitors.
  • Avoid linking to the Wikipedia article or website of your organization in other articles (see Wikipedia:Spam).
  • Exercise great caution so that you do not accidentally breach Wikipedia's content policies.

Please familiarize yourself with relevant content policies and guidelines, especially those pertaining to neutral point of view, verifiability of information, and autobiographies.
