There isn't much background to speak of...
And despite it being from the Official Handbook Of The Marvel Universe, the source was listed along with the year of publication along with the illustrator...

Stop when you get to it having been lifted from Official Handbook Of The Marvel Universe. Based on the guide lines for fair use, we cannot take images from other encyclopedias or like publications. Period.
The character has seen use in other stories and covers published by Marvel Comics. Those are the sources to pull the image from. - J Greb 20:32, 7 October 2007 (UTC)[reply]

Nonsense... both images referred are probably non-free (and definitely not good portraits) as anybody can see, since they were candid shots. The image in question is an OFFICIAL image, that falls under the Chilean law category of "in the public domain". Mel Romero 00:56, 3 October 2007 (UTC)[reply]
The question is quite simple: if the picture is PD we can upload it on Commons and the problem is solved. If the picture is not free to use, there is absolutely no fair use RATIONALE because there is more than one free picture that can be used, despite not being so perfect. If we always want "perfect" pictures (therefore not using not-as-perfect-Commons-pictures) the guidelines for non free media of the Wikimedia Foundation can be thrown in the garbage.   • this image is not necessary considering how many free images we have of josephine baker (about a dozen, spanning from the 1920s to the 1950s). the main editor of the page argues it's being used to show the costumes she's known for, but these aren't discussed anywhere in the main text and he keeps moving it to the top of the article to be the article's main image. we could describe these costumes in words and readers would know no less about baker Calliopejen1 19:20, 2 October 2007 (UTC)[reply]

actually, with regard to the "free" images, there are only 3 that are not the typical banana images from the 20s. I have uploaded images before that are far more representative of Baker as she looked as a performer, but they are always challenged by Calliopejen1, in spite of the fact that I clearly give a rationale that is logical. Free images uploaded into the commons or not, I really dont see why it is being made into such a stink. The images have been fully justified and do not infringe on any of teh copyright holders. I have requested that Calliopejen1 should help to find a way to keep the images rather than trying to get rid of them, by assisting me in choosing the proper way in which to give a rationale for an image when "free" ones are available. --Mrlopez2681 20:08, 2 October 2007 (UTC)[reply]
It's not just me making a stink. There were also other users on the talk page, and the admin who agreed that I was right and deleted the other nonfree images earlier. And the commons images are the reasons for the stink! By my count, there are four banana pictures, four other 1920s pictures, and four later pictures (last ones from 1951). This is plenty of pictures to illustrate the article. The problem is not that a new rationale should be written, it is that different (free) pictures should be used, because Wikipedia is the free encyclopedia.   • UE, OR, LQ and suspected CV: Uploader replaced the official Ethiopian flag with this image in the Ethiopia article. The tree emblem is an Oromo reference (compare Image:Et oromo.png, Image:Oromia flag.gif). Might be encyclopedic if it can be demonstrated that this is in wide political/activist use (and assuming that the other problems can be resolved). Orphaned as of this writing. Note the color variation; these should be solid colors. This, in turn, suggests this is a copy of a copy, and thus a possible copyvio. Gyrofrog (talk) 22:29, 2 October 2007 (UTC)[reply]
