The result of the discussion was: - Delete - per NFCC#1 (replaceable with a free alternate). If, as shown, the trailer is PD then either the existing images are sufficient or another image can be taken from the trailer that will satisfy the same purpose as this copyrighted work - Peripitus (Talk) 21:39, 22 December 2008 (UTC)[reply]

- Delete - free or public domain images have been located for this film: Category:The Palm Beach Story (1942 film) - Wikimedia Commons Britneysaints (talk) 02:00, 16 December 2008 (UTC)[reply]
- Keep - True, but none of those images show the film's two stars, Joel McCrea and Claudette Colbert, together as a couple, which is the focal point of the story (their relationship). Ed Fitzgerald t / c 02:16, 16 December 2008 (UTC)[reply]
- Keep - In fact, this image, a screenshot, meets the same public domain licensing issues as the ones on WikiCommons, and would thus, be a candidate for transfer to WikiCommons. This is a non-issue. Wildhartlivie (talk)
- Keep - yes, there are public domain images, and they could be used as decoration in the article, but they are less relevant than this one. This is used appropriately, complements discussion of the article, and has a fair use rationale that is equal to numerous others that are accepted without question. This particular image serves a useful purpose that is not served by any of the images referred to by the nominator. Rossrs (talk) 13:39, 16 December 2008 (UTC)[reply]
- 1) No, this image isn't public domain, and cannot be a candidate for transfer to WikiCommons. Source: [1] Only trailer screenshots are free. (See: File:Palm Beach Story-Claudette Colbert.JPG) - The movie is copyrighted, however, the trailer is published (run in a theater) before the movie itself is published [2], and the old trailer requires a separate copyright. [3]
2) Quality is not relevant. These free images [4] are acceptable quality. We simply don't use an non-free image when a free one will suffice. Purpose is to show what this film looked like. (WP:NFCC #1)
3) The photo File:Palm Beach Story McCrea Colbert.jpg does not “significantly increase readers' understanding of the topic” (WP:NFCC #8).
4) No minimal usage per WP:NFCC#3a. Other non-free images and free image have been included in the article. —Preceding unsigned comment added by Britneysaints (talk • contribs) 12:38, 17 December 2008 (UTC)[reply]
- But Britneysaints, some of the unfree images in use were included/kept by you in your recent edits. You've singled this one out without explaining why you believe it is different. The manner in which the other unfree images are used in this article is no different to the use of this image, and yet you object to this one, while not objecting to the others. This seems to contradict your comments here regarding the suitability of this image on the basis of copyright. It looks like you have selected some images as OK to use, and this image not OK to use, and while I don't understand your reasoning, I have to assume it's because you don't like this image. Rossrs (talk) 14:01, 18 December 2008 (UTC)[reply]

- Delete. The rationale states that the image is intended to illustrate its subject, Steve Gatena, singing a song. Per WP:NFC, fair use claims for non-free images of living individuals are not applicable to articles about such individuals, so the claimed rationale is clearly invalid. It is now deprecated as a new version with the correct licence has been uplodated to Image:Morrissey Maladjusted.jpg. The result of the discussion was: delete. Can be replaced by quotes from the ad itself. howcheng {chat} 00:57, 24 December 2008 (UTC)[reply]
- File:Falwellhustler.jpg (delete | talk | history | logs) - uploaded by Jaysscholar (notify | contribs).
- While the advertisement played a critical role in the landmark Hustler Magazine v. Falwell Supreme Court case, I can't see how the image itself meets the NFCC. Specifically:
1. No free equivalent: The article provides a a handful of quotes that convey the gist of the image.
8. Significance: The image itself is too small to read in the article and provides only an indication of the layout and format of the ad. Burzmali (talk) 17:32, 16 December 2008 (UTC)[reply]
- Speedy keep (& troutsmack for the deletion rationale) The ad in question was the very source of controversy, its usage satisfies any sane reading of NFCC and then some. If the image is too small or too muddy to read, then upload a better version! Resolution maximums are not set in stone - they never were. Any web-resolution rendering of the add passes U.S. copyright law standards for educational use/critical commentary and does not diminish the market value of a decades-old dirty joke. ˉˉanetode╦╩ 03:51, 17 December 2008 (UTC)[reply]
- Wikipedia's policy is more strict than U.S. copyright law, and the article the picture appears in isn't critical commentary about the ad. I'm not arguing that that image isn't a good addition to the article or that it doesn't increases the understanding of the subject. However, that alone isn't enough to satisfy NFCC 8. What does the image bring that the text quotes don't? Did the SCOTUS case mention Falwell's picture, the bottle, glass, or layout of the ad? Burzmali (talk) 13:54, 17 December 2008 (UTC)[reply]
- No, Wikipedia's "policy" is an editorial guide to making good decisions that encourage the creation of free content when available and being cautious about claiming fair use on content when no free alternative is available. Discounting a rendering of the very subject of an article is plain idiocy, no matter what tedious dissection of NFCC#8 you propose. I'm not inclined to get locked in wikilawyering over such an obvious case, and I'd like to suggest that you seriously consider how much time is wasted by such frivolous nominations. ˉˉanetode╦╩ 18:49, 17 December 2008 (UTC)[reply]
- Sorry to belabor the point, but the subject of the article is the lawsuit. The subject of the lawsuit was the content of the ad. If the image is significant to the article, how is it that it has been left in an unreadable form for so long? It makes the article look professional, but it is still non-free and should be removed if it fails to meet the NFCC policy. Burzmali (talk) 19:34, 17 December 2008 (UTC)[reply]
