This clip of Tim Buckley's "Song of the Magician", taken from the album Tim Buckley is used for the purposes of criticism and comment on the artist Tim Buckley, his eponymous debut album and the piece "Song of the Magician". At 30 seconds long it is significantly shorter than the complete original recording and I believe that this sample will not affect the value of the original work or limit the copyright holder's rights or ability to distribute the original recording. It is intended, in the context of scholarship, to inform the reader of the sound of Tim Buckley while not displacing the original product.

According to section 107 of the United States Copyright Act of 1976:
