The Cases were released on bond one day after being charged.[3][4][5] In November 2022, the aggravated assault charges were upgraded to attempted first-degree murder and Gibson's lawyers have called for a federal hate crime probe into the shooting.[6] The trial began on August 15, 2023.[7] However, two days later the judge granted the defense motion for a mistrial citing a video not being turned over to the prosecution or defense by the Brookhaven Police Department.[8]
