This page is being created to add a Wikipedia entry for Acquavella Galleries. The summary is taken from the official Acquavella site (http://www.acquavellagalleries.com/gallery/).

The alleged copyright infringement from http://www.museum.com/ja/gallery/id=318 is not correct, as museum.com is not the official site of the gallery, and the text on museum.com's site is actually taken from the official Acquavella site.

The text is from http://www.museum.com/ja/gallery/id=318 and in this case that text has a copyright indication at the bottom of that page, please note, the copyright symbol is not necessary to establish a copyrighted material in newer text. I do not see any indication of it existing at the site you mentioned, but that is not relevant. It is a violation of WP:COPY and U.S. copyright laws. ttonyb1 (talk) 18:23, 24 June 2009 (UTC)Reply

The text on http://www.museum.com/ja/gallery/id=318 is clearly a verbatim copy of the description of the gallery from its official website at http://www.acquavellagalleries.com/gallery/, which does not specify a copyright. Museum.com is simply an unofficial directory of galleries and museums, and does not represent any of the listed institutions. The copyright at the bottom of the page is a sitewide footer, but since the description of the museum.com directory page was clearly taken from the official Acquavella site, it does not constitute a proper copyright.

As I indicated, recently published text need not have a copyright symbol in order for it to be copyrighted. The 1976 Copyright Act requirement was eliminated March 1, 1989 when the United States adhered to the Berne Convention. The said copyrighted text has been replaced with a new written description of the gallery.
