Authors of the declaration of independence

edit

The note currently says that: "The Assembly of Kosovo declared its independence on 17 February 2008" The question of which the Authors of the declaration of independence (the "Declaration") is a matter of dispute.

The authors of the declaration clearly state that the are “We, the democratically elected leaders of our people...” http://news.bbc.co.uk/1/hi/world/europe/7249677.stm (about half way down.)

Serbia always maintained that it was the Provisional Institutions of Self-Government, which being provisional, could not legally adopt any permanent declaration of independence.

In the judgement of the International Court of Justice, the “the authors of the declaration of independence of 17 February 2008 did not act as one of the Provisional Institutions of Self-Government within the Constitutional Framework, but rather as persons who acted together in their capacity as representatives of the people of Kosovo outside the framework of the interim administration.” http://www.icj-cij.org/docket/files/141/16010.pdf Section 2(a) The identity of the authors of the declaration of independence - Pages 11 & 12.

Saying that the authors were “the democratically elected leaders of [the] people [of Kosovo]”could be pro-independence POV, even though it is factually correct, per the ICJ Judgement.

Saying that the authors were “the The Assembly of Kosovo” (which is one of Provisional Institutions of Self-Government) is pro Serbia POV.

Saying that the authors are “persons who acted together in their capacity as representatives of the people of Kosovo” is neutral POV (Coming from the judgement of the International Court of Justice, however it is a mouthful to say).

I think the best neural POV solution is not to mention who the authors are. 2007apm (talk) 21:35, 12 August 2010 (UTC)Reply

I have edited the article International Court of Justice advisory opinion on Kosovo's declaration of independence to reflect this. I did so by stating the declaration was "adopted at a meeting of the Assembly", which I think is neutral and reflects the facts.--Rallette (talk) 09:59, 7 October 2010 (UTC)Reply

PISG Assembly and RoK Assembly

edit

Related to these questions. Since UNSCR1244 and UNMIK are still de-jure in force - what is the current relation between the PISG Assembly and the RoK Assembly and what was the process of succession/transformation for all PISG institutions into RoK institutions? What is the UNMIK position over RoK and its institutions actions after the declaration of independence? Alinor (talk) 10:41, 9 January 2011 (UTC)Reply

Naming/moves.

edit

Iaof2017, I have reverted your changes here and to Assembly of Kosovo as you cannot perform a move like that. Please see WP:MOVE. Step one would be discussion on this page and then go from there. That said, I also find the original moves by Dardn2015 baffling, since the correct WP:COMMONNAME is the Assembly of Kosovo. Fixing things so that this article is at Assembly of Kosovo would require a technical move at WP:RM. ~Hydronium~Hydroxide~(Talk)~ 07:38, 18 June 2017 (UTC)Reply
