A contract can include a modified time-of-the-essence clause, which provides that a party can declare time to be of the essence AFTER the contract has been signed. A typical clause would read as follows:
Modified Time of Essence. If full performance of this Agreement is not completed by the date set forth in Paragraph ___, either party shall have the right after that date to declare time to be of the essence of this Agreement by giving written notice to the other party.
