What's the purpose of the parenthetical clause? Beside suspecting it's misleading (I know of some countries where 15 year olds can legally consent to other 16/ 17 year olds, but not to adults, but I don't know about the Czech Republic), it seems irrelevant. It is meant to stress out that this wasn't issue of statutory rape (i.e. legal inability to provide consent, i.e. willing child engaging in an act not allowed by law), but true rape of a child (i.e. forceful sexual act against the victim's stated will).
