editAlthough the only sourced information regarding this closing cited competition and property values and primary causes, Locals recall the legal battles with neighbors in the suburb of Westerville over noise complaints. In 2005, The City of Columbus agreed to a deal with The City of Westerville that Westerville can enforce it's noise ordinance against violators actually inside Columbus city limits. In short, Germain is on the city line, makes enough noise to set off complaints in Westerville, and Westerville can cite Germain for the complaint. Germain claimed they cannot control the volume of the acts on the stage, but were still fined approx $5000 per violation, and with 5 or 6 concerts per week, the fines could be staggering. The 2006 Concert Season had Germain charging acts a $5000 deposit, refundable if they did not violate the noise ordinance. Media reported Westerville set up noise monitors along the City line to record dB levels. A violation was defined as approx 90dB, or about the volume of a lawn mower.
