amicus curiae from usa
editI found this in the news and am unsatisfied. (see clip from article here).
- These are not even charges. A charge lists an action performed and comlained of and an ill effect that would be knowable. A meaninglessly vague reference to code is not sufficient to make accusations with. What did Ian himself do? What act?
- Ian is assumed to act in the best interest of his family. That is the primary assumption and it is good.
- The article said Ian owned the property and parts of the exploration company. Thus if he hires "his own" to do work on his land that is his perogative.
- A judge should not be allowing defamation before trail nor the case to open without a clear act that clearly falls within a clearly written and interpreted law. I don't see they should be bothering Ian with many trials unless they can ask a proper question. And if one reads the article one can see (that kind) of response from defense (that no wrong-doing occurred or has been stated yet). Thus he should not be harassed by the Court. Easily Law does legal injury that way. Infact i'd go sofar to say that injuries are owed if any of these claims prove false (which is why one should not publicly cry defaming things before a trial wont only).
One could question if he gained the land by ill political means (in the usa such charges are frequent). But that is not questioned. But if he can sell coal mining rights to what is in part his own company? Can he mine coal from his property? I can't see why that is wrong-doing. As Australians you all need to look into taxation closer. What you don't need is legal people tying up Ian's (and the State's) time and money on bogus things. I'm sure time would be better spend persuing mining methods and town jobs with the new coal mine, I should wonder. "Ian Macdonald:
- For the criminal offences of conspiracy to defraud or misconduct in public office in relation to his conduct in agreeing with Eddie and Moses Obeid to arrange for the creation of the Mount Penny coal tenement.
- His conduct in providing Moses Obeid or other members of the Obeid family with confidential information for the purpose of financially benefiting the family."
Thank you all. I'm sure there are facts I may not be aware of i'm just going by today's articles here in the usa. — Preceding unsigned comment added by 72.209.222.174 (talk) 16:32, 1 August 2013 (UTC)
