Not gender; Sex
editSex is characteristic; gender is attributive.
These are sex terms: male, female, androgyne (psychological),intersex (physical), null characteristic
These are gender terms: masculine, feminine, androgynous, no gender (aka non-binary, etc.), etc
Gender does not necessarily correlate to sex, viz. there are men who are very feminine and women who are very masculine; but most people display both masculine and feminine behaviours.
In particular, in the USA, the word gender does not appear in the U.S. Constitution - but the word sex does. U.S. Const., Amend. XIX: "The right of citizens of the United States to vote shall not be denied or abridged by the United States or by any State on account of sex." Your right to vote cannot be abridged or denied based on the characteristics that make one male, female, intersex, etc. Whether one's behaviours are classed as masculine, feminine, androgynous, is not the least bit relevant.
The title of this article should be List of sex equality lawsuits. The suits are not based upon equality of people as masculine and feminine but on equality of people as male and female.
