Why is not the USSC Taney - Dred Scott decision not on the list page??? 72.211.218.50 (talk) 13:53, 2 September 2015 (UTC)Reply

The Dred Scott decision was overturned by the 14th Amendment, not by a court decision. Kaltenmeyer (talk) 15:33, 5 September 2018 (UTC)Reply

What about Pace v. Alabama (106 U.S. 583) overturned by Loving v. Virginia (anti-miscegenation) — Preceding unsigned comment added by 67.166.125.35 (talk) 07:23, 19 February 2016 (UTC)Reply

Loving says that the reasoning of Pace has previously been rejected by an 1964 decision, McLaughlin, but Loving does not explicitly overrule Pace. Kaltenmeyer (talk) 15:33, 5 September 2018 (UTC)Reply

86 Missing overruling cases?

edit

This list from the Government Printing Office, cited at the bottom of the Wiki article, lists 179 explicit decisions (marked with an asterisk) that overruled previous decisions (and 233 total) through 2010. But this Wiki page only has 137 instances of a decision explicitly overruling another decision (and, since many overturn several decisions, only 115 actual overruling cases). Does anyone know why so many of the decisions on the GPO list are not included here?

For example, the last case on the GPO list is McDonald v. City of Chicago As the info box on the Wiki page for that decision says "This case overturned a previous ruling or rulings: United States v. Cruikshank (1876) (in part); Presser v. Illinois (1886)". The GPO list says it also overruled Miller v. Texas 153 U.S. 535 (1894).

Here are the 86 GPO explicit overruling cases not listed in this article. Note that I've linked to cases that have a Wikipedia page and that page also indicates that the case overruled precedent.

These 4 cases are listed in the Wiki article as explicitly overruling, but the GPO lists them as non-explicit:

This could be just a difference of opinion.

The Wiki article includes these 6 additional cases which the GPO list does not have (as well as 13 cases decided since the GPO list was published in 2010):

Overruled vs overturned, and multiple overturns

edit

Hi, are "overruled" (used in title of this article) and "overturned" the same thing? I'd considered a decision overruled both by an overturn (later Court reverses earlier decision) or by a new law or amendment undoing an earlier decision (13th/14th amendments overruled Dred Scott case by that notion). I may be using terminology incorrectly though.

Also, are there cases that the Sup Ct reversed more than once? Like Lawrence v. Texas reversed some earlier decisions, but Justice Thomas proposed that the current court reverse Lawrence v. Texas, so the two reversals would cancel each other out. I'm wondering whether anything like that has actually happened. If yes, it should probably be noted in the article. Thanks. 2601:644:8501:AAF0:0:0:0:9BB0 (talk) 20:05, 1 July 2024 (UTC)Reply
