Marriage solely for immigration?

if marriage was only to bring someone from overseas and one of the parties was forced to marry is it duress and fraud and does it constitute a void marriage?

There is not one word about what preceded the 1961 Act and this information is generally difficult to find on Wiki. Too many commentators of marriage only go back this far yet want to claim tradition as a key factor in preventing marriage equality. Is the inherent unfairness of marriage prior to this Act why this history is missing from both wiki and conservative activism? Ericglare (talk) 10:40, 15 September 2014 (UTC)Reply

Wikipedia page Marriage Act 1961 (Australia) does not explain the context of why the Act was introduced. Instead, the page deviates from the Act 1961 thru the Sexual Discrimination Amendment Act 1991 the to the Amendment Act 2004 in order to repeat the point that same sex marriage is not permitted. This is more a case of intended waffle than an account of the facts. The page incorrectly includes a section on the "current status of the Marriage Amendment Act". This section is out of date and refers to a spurious selection on where certain politicians stood on the issue over the past decade. The section ignores the currency of the debate over a plebiscite on same-sex marriage versus the role of Parliament to legislate directly on this.

What's missing?

  • 1) A satisfactory consolidation of the Marriage Act in Australia.
  • 2) Marriage Acts of Australian States/self-governing colonies & historical view of marriage.
  • 3) The jurisdiction of Australian marriage law under the Constitution.
  • 4) The background to and detail of the Marriage Act 1961 (e.g. debate about polygamy vs conventional view of marriage).
  • 5) The background to the Marriage Amendment Act 2004 (e.g. debate about same-sex marriage vs the view of the Howard Government).
  • 6) Proposed plebiscite on same-sex marriage by the Coalition vs advocates for Parliament to vote directly on the issue.
