Torrent files (.torrent) are files that include hashing algorythm checksums, as stated i Bittorent article: BitTorrent_(protocol)#Creating_and_publishing_torrents . (TW)) Torrents does not need to have copyright themselves. They are just hashes and they describe content. So unless maker of an torrent file is making that particular .torrent file under some license, you can say torrent is "copyrighted". I do not think any torrent I seen is copyrighted. So torrents them self are not copyright material.

All torrents are legal, like this text i am witting and I can save under any file name i want, say i name it with .torrent.extension. So Act of distributing someone others owned material have nothing to do with .torrent files. Distributing .torrent files have nothing to do with actual files distribution. Try asking google. Even Wikipedia is based on providing descriptions of world around us. Could you say an article ABOUT something is someone else`s property, but mine? I own it and I distribute descriptions, articles and my files how ever I like.
