Makdessi decision
editThe Supreme Court handed down the decision in Makdessi yesterday, which obviously will recast the contents of this article. The historical discussion in Makdessi' should be treated with some care, and might be worth contrasting with the account given in Meagher, Gummow & Lehane's Equity: Doctrine and Remedies (5th ed, 2015, LexisNexis) and of course the Andrews v ANZ decision. This is particularly so with the Court's treatment of the breach requirement.
