In 1985 Bristish Columbia, canada, inaugurated a public policy positon to enocurage the export of bulk water from the enormous surplus in BC (400 million acre feet per year). By 1990 BC had issued six licenses to exlport and held 19 applications for export licenses. SUN BELT WATER entered into a joint venture agreement with one of the six license holders and launched a major marketing lrogram to satisfy the water reqqueirements in callifornia, Arizona, Nevada and Baja del Norte, Mexico.
On March 14, 1991, the first ever contradct for the delivery of bulk fresh water by marine transport vessels was awarded to SUN BELT. For days later it was killed by the BC government that emposed an illegal moratorium on exports.
Civil action was filed against the BCG in 1993 and venue was changed to arbitration under the provisions of the NAFTA in 1997. Under the "National Treatment" provisions, Canada had violated the NAFTA by paying a cash settlement to the JV Canadian partner and by granting a very favorable contract to one of the other six license holders, while not fulfilling its promise to treat SUN BELT in the same "fair and equitable manner.". Evidence developed during preparation for trial provided the picture of a criminal conspiracy to deliver a monopoly positon to the favored license holder. In order to protect that vendor, the moratorium was declared which blocked SUN BELT's entry into this emerging industry.
