In New York, the term "Special Needs Trust" is used for a first party self-settled trusts, funded with the assets of the disabled person; the term "Supplemental Needs Trust" generally is referred to as a Trust created for a a disabled person with another's funds. These Trust stem from case law which was codified into Section 7-1.12 of the New York Estates Powers and Trusts Law.
