Consideration of potential accession to the Optional Protocol to the Convention against Torture (OP-CAT) is ongoing. Canada values independent oversight of conditions in places of detention, which plays a crucial role in improving conditions and preventing ill-treatment.

As our federal-provincial-territorial (FPT) consultations on OP-CAT have revealed, Canada has many well-established, robust domestic mechanisms in place to ensure that detainees are treated in accordance with international standards.

A number of these bodies have the level of independence envisioned by the OP-CAT, and also currently perform functions similar to those envisioned in the OP-CAT, by carrying out visits to facilities on a proactive basis. However, the core focus of the great majority of existing independent bodies is on addressing individual complaints, rather than preventing mistreatment on a systemic basis.

To date, the consultation process has involved extensive consultation with provincial and territorial governments, and also within the Government of Canada. While we recognize that this process is taking longer than expected, further consultations and analysis are required to find an effective and efficient approach to building a system of independent monitoring in Canada’s federal system.

Despite all of this, there are a range of policy and implementation issues and additional consultations that still need to be undertaken (such as the assessment of the legislative, financial and operational implications of different implementation models, and consultations with municipal government stakeholders, Indigenous partners, and civil society organizations). Introduction to contentious topics
