License tagging for Image:BruceHornsby.jpg

Thanks for uploading Image:BruceHornsby.jpg. Wikipedia gets thousands of images uploaded every day, and in order to verify that the images can be legally used on Wikipedia, the source and copyright status must be indicated. Images need to have an image tag applied to the image description page indicating the copyright status of the image. This uniform and easy-to-understand method of indicating the license status allows potential re-users of the images to know what they are allowed to do with the images.

Thanks for uploading Image:BruceFace.jpg. I noticed that the file's description page currently doesn't specify who created the content, so the copyright status is unclear. If you did not create this file yourself, then you will need to specify the owner of the copyright. If you obtained it from a website, then a link to the website from which it was taken, together with a restatement of that website's terms of use of its content, is usually sufficient information. However, if the copyright holder is different from the website's publisher, then their copyright should also be acknowledged.

As well as adding the source, please add a proper copyright licensing tag if the file doesn't have one already. If you created/took the picture, audio, or video then the {{GFDL-self-no-disclaimers}} tag can be used to release it under the GFDL. If you believe the media meets the criteria at Wikipedia:Fair use, use a tag such as {{Non-free fair use in|article name}} or one of the other tags listed at Wikipedia:Image copyright tags#Fair use. See Wikipedia:Image copyright tags for the full list of copyright tags that you can use.

Please read Wikipedia:Fair use if you have not yet and look at the policy section, especially number 10 and the counterexamples, especially number 8. Another good article is fair use. Your Hornsby images like Image:BruceHornsby.jpg are not sourced. You have to list the copyright holder for the image. Also, an image merely for identificaton is not fair use. You have to have commentary or critism about the image. See Oklahoma_City_bombing#Effects_on_children for an example. Commentary on the copyrighted image to the right is incorporated into the article.

Remember, all images after 1923 are copyrighted by default. Display on the web does not make them public domain, GFDL or Creative Commons, unless there is specific release by the copyright holder to that effect. -Hope this helps Nv8200p talk 04:19, 27 February 2007 (UTC)Reply

I notice the 'image' page specifies that the image is being used under fair use, but its use in Wikipedia articles fails our first fair use criterion in that it illustrates a subject for which a freely licensed image could reasonably be found or created that provides substantially the same information. If you believe this image is not replaceable, please:

  1. Go to the image description page and edit it to add {{Replaceable fair use disputed}}, without deleting the original Replaceable fair use template.
  2. On the image discussion page, write the reason why this image is not replaceable at all.

Alternatively, you can also choose to replace the fair use image by finding a freely licensed image of its subject, requesting that the copyright holder release this (or a similar) image under a free license, or by taking a picture of it yourself.

Onus is on you, not I

I am afraid that you are wrong in assuming that I should help you replace the unfree images you upload. The onus is squarely on your shoulders, not on myself to provide replacements for unfree images that you have uploaded. The source that you have given for the images you uploaded do not state that they are {{cc-by-2.0}}. You have incorrectly tagged them. Also, the source for Image:TreyAnastasio.jpg states that it is licensed under a {{Noncommercial}}, thus the tagging on wikipedia is incorrect, as stated on that image page, and it should also perhaps be deleted. Thank you for bringing it to my attention. I am assuming good faith in that you are unaware of copyright image policy on Wikipedia. Perhaps you should read Wikipedia:Image copyright tags. We cannot just tag images with copyright licenses that are incorrect. If you do not wish your talk page filled with instructions on how to deal with your uploads, perhaps you could correctly tag the images when you upload them. As you are obviously familiar with Flickr, there is a search option with which you could find free images. This is not harrassement, simply, if I see a user uploading a couple of images under incorrect tags, then I check your upload log to see if there are more of the same. The three images that you just uploaded, the album cover requires a source and the two from flickr used the wrong license. I like your edits to Bruce Hornsby (I've been editing here and there via anonymous IP), but not for some time. It was really cool to come back to the article this week and find so much more there. It's really solid work.
