User talk:Cjmarsicano/Oldintropage

Stop: Are you here to ask about an image I uploaded? Please prove that the image in question is indeed replaceable first before wasting both my time and yours (99 times out of 100 you will find that is not the case, as I and may other editors who truly care about the quality of Wikipedia have learned), then show proper respect for both the image rationales that have been provided as well as the efforts of your fellow editors by reverting your sanctioned vandalism before I do it for you.

This user affirms and believes that the First Amendment supersedes the Wikimedia Foundation's ill-advised policy on so-called "non-free images" and that the use of these same so-called "non-free images" is protected by the Fair Use Clause of the US Copyright Act of 1976. If you have any further questions or concerns, please e-mail toughshit@cjmarsicano.com (Yes, it's an actual e-mail address).

GFDL

edit

If you plan on contributing to this project, you have to do so under the GFDL. We cannot accept the license you have chosen for yourself. For now, this account is blocked indefinitely. I will post a notice of this block on one of the administrators' noticeboards.—Ryūlóng (竜龍) 18:57, 15 July 2007 (UTC)Reply

Your userpage notice

edit

Please be advised that all contributions posted on Wikipedia are automatically licensed under the GDFL. This is a consequence of the notice displayed every time you post and this message will represent a further reminder of this fact. Your statement on your userpage that you do not accept such licensing is without effect and should be completely disregarded.

Moreover, because such statement is misleading and could be considered as a legal threat against those who may copy our content, which may include your contributions, I request that you remove it from your userpage immediately. Otherwise, the view could be taken that your contributions create a legal risk and that you should be blocked from editing, as has happened to other contributors making similar claims in the past. I trust that no matter what issues you may have with Wikipedia, you would not want this to happen. If there are any questions, please let me know. Newyorkbrad 18:59, 15 July 2007 (UTC)Reply

On top of the previously stated reasons I gave earlier, I obviously cannot make that revision because I am blocked from doing so. Only a permanent unblocking can do that. --CJ Marsicano 19:17, 15 July 2007 (UTC)Reply
If you suck it up and agree not to be obstinate about Wikipedia:Non-free content (formerly Wikipedia:Fair use), then you will be unblocked. If you persist that your edits are under the Creative Commons non-derivative, atribution, non-commercial license, then you can't edit, as that conflicts directly with the multiple licensing the Wikimedia foundation uses. That's why directly below the window I am editting it says "You agree to license your contributions under the GFDL*" and "GNU Free Documentation License, Version 1.2 or any later version published by the Free Software Foundation; with no Invariant Sections, with no Front-Cover Texts, and with no Back-Cover Texts." If you disagree with the GFDL, you cannot click "Save page"—Ryūlóng (竜龍) 19:31, 15 July 2007 (UTC)Reply
Against my better judgment, I will allow these contributions under GDFL (but not solely under that as I still hold reservations about that particular license) for the indefinite time being, but that will not and never be the only license. I will determine a reasonable further multi-license (i.e. one I strongly agree with that falls within Wikipedia's boundaries) within the next 24 hours. That having been said, I still have my opinions about Wikimedia's flawed policies about so-called non-free images. If a solution is not found for these polices before Wikimedia becomes even more of an internet laughing stock, I cannot say with any certainty that there will be further major disagreements. CJ Marsicano 19:43, 15 July 2007 (UTC)Reply
I'd say that this is a good statement for unblocking. However, what fair use policy is now is very unlikely to bend to the whims of a singular group, as it had been rewritten to conform with a decree by the Wikimedia Foundation's board of trustees. I'll try and figure out the autoblock, too.—Ryūlóng (竜龍) 20:09, 15 July 2007 (UTC)Reply

A question

edit

By the way, nothing directly to do with the block or the licensing of your own contributions, but how can Wikipedia's licensing policy on images violate the First Amendment? The First Amendment, as part of the U.S. Constitution, constrains only governmental action (originally by the federal government, and then, as extended, by the states). The Wikimedia Foundation, of course, is a purely private entity. I could understand your disagreeing with Wikimedia policies on this or any issue, or even arguing that the policy somehow violated the copyright statute, but I don't see how even in theory they could violate the First Amendment. Regards, Newyorkbrad 19:52, 15 July 2007 (UTC)Reply

Restricting free speech is pretty much a violation of the First Amendment. The Supreme Court's decision on Acuff-Rose vs. Campbell determined that fair use was protected free speech. --CJ Marsicano 19:55, 15 July 2007 (UTC)Reply
First, the messages were removed by Gmaxwell. Second, like Newyorkbrad said, the Wikimedia Foundation is a private entity and the US Constitution only constrains actions by the government.—Ryūlóng (竜龍) 20:04, 15 July 2007 (UTC)Reply
Um, OK, but it still seems ridiculous. -- Ceej 20:12, 15 July 2007 (UTC)Reply
And thirdly, Campbell v. Acuff-Rose Music, Inc. is a ruling that commercial parody is not presumptively unfair use. It's got absolutely nothing to do with Wikipedia, and nothing to do with the First Amendment. --Carnildo 21:55, 15 July 2007 (UTC)Reply
Wrong on all counts. I know more about that case than you do. That case is solid enough grounds for backing up fair use of copyrighted material as constitutionally protected free speech. It has more to do with the issue at hand than you are willing to admit, and that includes this website and how its run. -- Ceej 01:59, 16 July 2007 (UTC)Reply

GFDL licensing

edit

Greetings! My attention was brought to your userpage due to the issues with licensing. I've altered your statement on your user page to reflect what it seems from the discussions you've had that you meant to say; stating that you are licensing "partially" under the GFDL is misleading if you intended to dual- or multi-license your contributions. (Please note that this means that anyone who wishes to reuse them may do so under either the terms of the GFDL or whichever CC license you choose, and only has to abide by the terms of one or the other.) Thanks, Kat Walsh (spill your mind?) 22:26, 15 July 2007 (UTC)Reply

Replaceable fair use Image:Watt_missingmen.jpg

Replaceable fair use

Thanks for uploading Image:Watt_missingmen.jpg. I notice the 'image' page specifies that the image is being used under fair use, but its use in Wikipedia articles fails our first fair use criterion in that it illustrates a subject for which a freely licensed image could reasonably be found or created that provides substantially the same information. If you believe this image is not replaceable, please:

  1. Go to the image description page and edit it to add {{di-replaceable fair use disputed}}, without deleting the original Replaceable fair use template.
  2. On the image discussion page, write the reason why this image is not replaceable at all.

Alternatively, you can also choose to replace the fair use image by finding a freely licensed image of its subject, requesting that the copyright holder release this (or a similar) image under a free license, or by taking a picture of it yourself.

If you have uploaded other fair use media, consider checking that you have specified how these images fully satisfy our fair use criteria. You can find a list of 'image' pages you have edited by clicking on this link. Note that fair use images which could be replaced by free-licensed alternatives will be deleted 7 days after this notification, per our Fair Use policy. If you have any questions please ask them at the Media copyright questions page. Thank you. – Quadell (talk) (random) 23:23, 16 July 2007 (UTC)Reply

If you continue to remove "replaceable fair use" tags in violation of policy, you will be blocked from editing. If you believe that an image is not replaceable, please add {{di-replaceable fair use disputed}} to the image description page, and leave a note on the talk page why you think it would not be possible to create a new free image with the same encyclopedic content as this non-free image. Thanks, – Quadell (talk) (random) 02:44, 17 July 2007 (UTC)Reply

That divbox that is currently on my user page DOES NOT BELONG ON MY TALK PAGE. Please respect my space or I will bring the matter up with admins, some of whom I've made nice with in the past couple of days

About that, well when I saw that you left because of the BS image policies, my initial reaction was to lash out against the "image Nazis" that caused you to abandon what you once loved. You may recall my run-in with Chowbok that happened last fall. I embroiled myself into a dispute over the photo of Mike Watt, which was sent by the man himself, yet was still tagged. I had my images tagged by Chowbok as well,so that's how that happened.

When, I got your message, I felt horrible that I got on your bad side to say the least. As for me editing your page, seriously never happening again. Nuff said. --Adamv88 04:41, 20 July 2007 (UTC)Reply

Unspecified source for Image:Bgc97a.jpg

edit

Thanks for uploading Image:Bgc97a.jpg. I noticed that the file's description page currently doesn't specify who created the content, so the copyright status is unclear. If you did not create this file yourself, then you will need to specify the owner of the copyright. If you obtained it from a website, then a link to the website from which it was taken, together with a restatement of that website's terms of use of its content, is usually sufficient information. However, if the copyright holder is different from the website's publisher, then their copyright should also be acknowledged.

As well as adding the source, please add a proper copyright licensing tag if the file doesn't have one already. If you created/took the picture, audio, or video then the {{GFDL-self}} tag can be used to release it under the GFDL. If you believe the media meets the criteria at Wikipedia:Fair use, use a tag such as {{non-free fair use in|article name}} or one of the other tags listed at Wikipedia:Image copyright tags#Fair use. See Wikipedia:Image copyright tags for the full list of copyright tags that you can use.

If you have uploaded other files, consider checking that you have specified their source and tagged them, too. You can find a list of files you have uploaded by following this link. Unsourced and untagged images may be deleted one week after they have been tagged, as described on criteria for speedy deletion. If the image is copyrighted under a non-free license (per Wikipedia:Fair use) then the image will be deleted 48 hours after 09:57, 23 July 2007 (UTC). Fair use rationale for Image:Bgang98c.gif

edit

Thanks for uploading or contributing to Image:Bgang98c.gif. I notice the image page specifies that the image is being used under fair use but there is no explanation or rationale as to why its use in Wikipedia articles constitutes fair use. In addition to the boilerplate fair use template, you must also write out on the image description page a specific explanation or rationale for why using this image in each article is consistent with fair use. Suggestions on how to do so can be found here.

Please go to the image description page and edit it to include a fair use rationale. Using one of the templates at Wikipedia:Fair use rationale guideline is an easy way to ensure that your image is in compliance with Wikipedia policy, but remember that you must complete the template. Do not simply insert a blank template on an image page.

If you have uploaded other fair use media, consider checking that you have specified the fair use rationale on those pages too. You can find a list of 'image' pages you have edited by clicking on the "my contributions" link (it is located at the very top of any Wikipedia page when you are logged in), and then selecting "Image" from the dropdown box. Note that any non-free media lacking such an explanation will be deleted one week after they have been uploaded, as described on criteria for speedy deletion.   Thanks for uploading Image:Jandek0749.jpg. The media description page currently specifies that it is non-free and may only be used on Wikipedia under a claim of fair use. However, it is currently orphaned, meaning that it is not used in any articles on Wikipedia. If the media was previously in an article, please go to the article and see why it was removed. You may add it back if you think that that will be useful. However, please note that media for which a replacement could be created are not acceptable for use on Wikipedia (see our policy for non-free media).

Fair use rationale for Image:Wattfrompedrologo.jpg

edit

Thanks for uploading or contributing to Image:Wattfrompedrologo.jpg. I notice the image page specifies that the image is being used under fair use but there is not a suitable explanation or rationale as to why each specific use in Wikipedia constitutes fair use. Please go to the image description page and edit it to include a fair use rationale.

Orphaned non-free image (Image:ThaCarterII Chopped.jpg)

edit

Thanks for uploading Image:ThaCarterII Chopped.jpg. The image description page currently specifies that the image is non-free and may only be used on Wikipedia under a claim of fair use. However, the image is currently orphaned, meaning that it is not used in any articles on Wikipedia. If the image was previously in an article, please go to the article and see why it was removed. You may add it back if you think that that will be useful. However, please note that images for which a replacement could be created are not acceptable for use on Wikipedia (see our policy for non-free media).

If you have uploaded other unlicensed media, please check whether they're used in any articles or not. You can find a list of 'image' pages you have edited by clicking on the "my contributions" link (it is located at the very top of any Wikipedia page when you are logged in), and then selecting "Image" from the dropdown box. Unspecified source for Image:Helloproject.jpg

edit

Thanks for uploading Image:Helloproject.jpg.

If the image is copyrighted under a non-free license (per Wikipedia:Fair use) then the image will be deleted 48 hours after 10:54, 12 January 2008 (UTC). If you have any questions please ask them at the Media copyright questions page. Thank you. OsamaK 10:54, 12 January 2008 (UTC)

Replaceable fair use Image:MerleAllin.gif

edit

Replaceable fair use

Thanks for uploading Image:MerleAllin.gif. I noticed the description page specifies that the media is being used under a claim of fair use, but its use in Wikipedia articles fails our first non-free content criterion in that it illustrates a subject for which a freely licensed media could reasonably be found or created that provides substantially the same information. If you believe this media is not replaceable, please:

  1. Go to the media description page and edit it to add {{di-replaceable fair use disputed}}, without deleting the original replaceable fair use template.
  2. On the image discussion page, write the reason why this image is not replaceable at all.

Alternatively, you can also choose to replace this non-free media by finding freely licensed media of the same subject, requesting that the copyright holder release this (or similar) media under a free license, or by taking a picture of it yourself.

If you have uploaded other non-free media, consider checking that you have specified how these images fully satisfy our non-free content criteria. You can find a list of description pages you have edited by clicking on this link. Note that even if you follow steps 1 and 2 above, non-free media which could be replaced by freely licensed alternatives will be deleted 2 days after this notification (7 days if uploaded before 13 July 2006), per our non-free content policy. If you have any questions please ask them at the Media copyright questions page. Thank you. Kelly hi! 02:07, 31 March 2008 (UTC)Reply

W3: Faithful

edit

A proposed deletion template has been added to the article W3: Faithful, suggesting that it be deleted according to the proposed deletion process. All contributions are appreciated, but this article may not satisfy Wikipedia's criteria for inclusion, and the deletion notice should explain why (see also "What Wikipedia is not" and Wikipedia's deletion policy). You may prevent the proposed deletion by removing the {{dated prod}} notice, but please explain why you disagree with the proposed deletion in your edit summary or on its talk page.

Please consider improving the article to address the issues raised because even though removing the deletion notice will prevent deletion through the proposed deletion process, the article may still be deleted if it matches any of the speedy deletion criteria or it can be sent to Articles for Deletion, where it may be deleted if consensus to delete is reached. Do you want to opt out of receiving this notice? Mdsummermsw (talk) 20:13, 21 April 2008 (UTC)Reply

You've indicated that the image is being used under a claim of fair use, but you have not provided an adequate explanation for why it meets Wikipedia's requirements for such images. Notification of the upcoming Wikimedia relicensing

edit

In case you are not aware, the Free Software Foundation has added terms to the GFDL 1.3 allowing the relicensing of certain content under the CC-BY-SA 3.0, and the community has approved with 75.8% in favor that this permission be used to dual-license all Wikimedia wikis under both licenses. On June 15, 2009, this change will take effect. This note is to let you know that {{WikimediaNoLicensing}} does not affect the relicensing of your contributions in this manner, as you cannot deny the terms of the GFDL. If you have any comments, please join the discusion at Wikipedia:Village pump (policy)#NoMultiLicense template. Anomie 16:56, 7 June 2009 (UTC)Reply

  • Source a Biography of a living person living in, born in, or otherwise affiliated with Macintosh/Apple
  • Help spread the word about the project
  • Update the project page or the portal

Fair use rationale for File:Benson-A5020.jpg

edit

Thanks for uploading or contributing to File:Benson-A5020.jpg. I notice the file page specifies that the file is being used under fair use but there is not a suitable explanation or rationale as to why each specific use in Wikipedia constitutes fair use. Please go to the file description page and edit it to include a fair use rationale.

If you have uploaded other fair use media, consider checking that you have specified the fair use rationale on those pages too. You can find a list of 'file' pages you have edited by clicking on the "my contributions" link (it is located at the very top of any Wikipedia page when you are logged in), and then selecting "File" from the dropdown box. Note that any non-free media lacking such an explanation will be deleted one week after they have been uploaded, as described on criteria for speedy deletion. If you have any questions please ask them at the Media copyright questions page. Thank you. Sfan00 IMG (talk) 13:44, 14 May 2010 (UTC)Reply
