File Copyright problem

Thanks for uploading File:First smiley.jpg. I noticed that the file's description page currently doesn't specify who created the content, so the copyright status is unclear. If you did not create this file yourself, you will need to specify the owner of the copyright. If you obtained it from a website, then a link to the website from which it was taken, together with a restatement of that website's terms of use of its content, is usually sufficient information. However, if the copyright holder is different from the website's publisher, their copyright should also be acknowledged.

As well as adding the source, we also need to know the terms of the license that the copyright holder has published the file under, usually done by adding a licensing tag. If you created/took the picture, audio, or video then the {{GFDL-self}} tag can be used to release it under the GFDL. If you believe the media meets the criteria at Wikipedia:Non-free content, use a tag such as {{non-free fair use in|article name}} or one of the other tags listed at Wikipedia:Image copyright tags#Fair use. See Wikipedia:Image copyright tags for the full list of copyright tags that you can use.

If you have uploaded other files, consider checking that you have specified their source and tagged them, too. You can find a list of files you have created in your upload log. Unsourced and untagged files may be deleted one week after they have been tagged, as described on criteria for speedy deletion. If the file is copyrighted under a non-free license (per Wikipedia:Fair use) then the file will be deleted 48 hours after 11:42, 15 December 2010 (UTC). Hello, I am the one who created the infobox, dispaying the correct information on it. However someone changed it to display wrong information and put an image that infragment the copyright of the Smiley face (yes it is trademarked and copyrighted). In fact not only the face but also the name are protected. I deleted the infobox temporarly, the time to find a way to upload the copyrighted which is the only one acceptable when you speak about the name "Smiley". if you can help me to upload this image to somewhere else than wikimedia as it does not allow copyrighted image that would be helpful. --Drinas (talk) 15:48, 22 December 2010 (UTC)

I checked the Smiley Company's website[1], it says "Copyright - 1000's of icons are protected by copyright for all products and service worldwide". That doesn't sound to me like having the copyright for the generic smiley face. You should provide an independent third-party source for that claim (usually a newspaper article will do, sometimes people manage to find books on copyright that cover the topic).

Anyways, I'll try to dig up some sources, since the article is a bit incomplete (for example, it lacks the exact year for Harvey Ball. And, according to the BBC, a guy called David Stern also claims being the creator) --Enric Naval (talk) 17:18, 22 December 2010 (UTC)

Yes SmileyWorld (franklin and Nicolas Loufrani's company) owns the right of the Smiley face and the name that is registered in 100 countries over 25 classes of goods. it is written on the link you just gave... The copyright concern SmileyWorld icons and the Smiley original is copyrighted and trademarked. Harvey balls claims to have designed it but there is exemples that shows it is not true, you will find previous use of happy faces e.g with the WMCA good guy (sse the article).
