If you have not created this file yourself, then there needs to be a justification explaining why we have the right to use it on Wikipedia (see copyright tagging below). If you did not create the file yourself, then you need to specify where it was found, i.e., in most cases link to the website where it was taken from, and the terms of use for content from that page.

Temporary removal of photograph during Replaceable fair use?

I reverted the article Tarik O'Regan so that it does not use File:Tarik Oregan 2011.jpg from while the Replaceable Fair Use dispute about the image is sorted out. But now File:Tarik Oregan 2011.jpg is listed as being orphaned while the dispute is discussed. What's the best way to sort this out? Thanks! Grovereaper (talk) 09:16, 14 December 2011 (UTC)
- The procedure for this is that if an image is deleted while a discussion is still going on, and the decision is that it can be used, then a post at Wikipedia:Requests for undeletion would get it restored. But in this case I don't think the image can be used. The claim that "all the other available images are non-free" won't get you past WP:NFC#UULP - the existing non-free images can't be used because, at least in theory, someone could photograph O'Regan tomorrow and release the photo under a free license. -- John of Reading (talk) 12:11, 14 December 2011 (UTC)

- Thanks for this. I've just checked and I can't find any non-free version of the this photo. I did notice that it's been deliberately re-scaled to a low resolution photo and is a scan of a publicity shot from a widely disseminated album called Threshold of Night. Clearly it would be useful to have the photo attached to the article, but I'm not sure of the correct way to do this. It's been there since 2008 it looks like. The photo illustrates the appearance of the artist and identifies him by recognized features. No free equivalent can equal this image, I believe. The image in this form is already widely distributed to identify Tarik O'Regan as part of catalogs and reviews, so we degrade no market value by providing it ourselves.Grovereaper (talk) 12:53, 9 December 2012 (UTC)
- Wikipedia's mission is specifically to be a free encyclopedia, not just another encyclopedia. Part of that means that we don't use non-free content when it can be avoided. That requires not only that no free image be readily available, but that no equivalent free image could be created. Is there a reason that anyone could not take a new picture of him, or a reason why this image in particular is noteworthy (e.g. sourced critical commentary about his appearance which can not be reproduced)? - Thanks for your reply. I think I understand. I don't know the subject of the article, but I like his music and I have tried to tidy up the article recently. I can't find another free version on the internet, but I'm not really sure how to look for one. I suppose the image is noteworthy because of the photographer, Marion Ettlinger. - In general I suggest looking on government sites (US federal works are always in the public domain and UK works are often released under the {{OGL}}) and Flickr. In this case I ran a search and unless I'm missing something there's a free image at http://www.flickr.com/photos/bowbrick/6301217935/. If that does look like the right Tarik O'Regan to you I can go ahead and upload that image over on Wikimedia Commons and use it in the article here. VernoWhitney (talk) 00:43, 10 December 2012 (UTC)
- Yes, that's him. That would be great if you could upload the photo, thank you. Thanks also for the wiki-education! Over time, I've tried to make the article a good example for a prominent, but young, classical composer. Is there anything I can do to make the article better? I realize it's not good enough yet for Good Article status (it failed when I nominated it before). Finally, if you have time, can you take a look at this discussion here: User_talk:Toccata_quarta#Tarik_O.27Regan. Do you have an opinion? The article used to include "partly of Algerian extraction" in the opening sentence (as per this revision http://en.wikipedia.org/w/index.php?title=Tarik_O%27Regan&oldid=527182445) but that phrase was removed. I can see why it was removed, but I do think his heritage is important to his notability as a composer (he appears to write much music based on his Algerian heritage, and there are not many Arab classical composers in the UK or USA). - Okay, I uploaded the free image and placed it into the article. I have noticed a few things which can be done to clean the article up, but I'll go through it later today or tomorrow when I have time to actually fix them myself or at least get into some specifics. I think Toccata quarta is correct as far as MOS:BIO goes unless there's a reliable source which discusses the relationship between his heritage and his music. I expect there wouldn't be a problem including it in the lead if there was some (sourced) critical commentary on it later on in the body of the article. makes sense I think. To be honest, I'm not really sure how the rules work with regard to album covers. Anyway, about once a year I try and update/maintain those two pages. I don't contribute much at all in general, but I try to use the maintenance of those two pages as a way of learning about Wikipedia and the various protocols. I had included a gallery of album covers, for example, but I think that's not permitted (is it because the page is about a composer, not the albums)? - Hey, thanks for this. I've tried over the years to maintain the page as best as I can (a longstanding personal interest), trying to comply with various policies as they've changed over the years. Obviously, hundreds of editors have contributed to the page in that time. I've always logged in and cited independent sources (although much information on composers comes from their publishers).
