Replaceable fair use File:Mike MUSCALA Sixers.jpg

edit

Thanks for uploading File:Mike MUSCALA Sixers.jpg. I noticed that this file is being used under a claim of fair use. However, I think that the way it is being used fails the first non-free content criterion. This criterion states that files used under claims of fair use may have no free equivalent; in other words, if the file could be adequately covered by a freely-licensed file or by text alone, then it may not be used on Wikipedia. If you believe this file is not replaceable, please:

  1. Go to the file description page and add the text {{Di-replaceable fair use disputed|<your reason>}} below the original replaceable fair use template, replacing <your reason> with a short explanation of why the file is not replaceable.
  2. On the file discussion page, write a full explanation of why you believe the file is not replaceable.

Alternatively, you can also choose to replace this non-free media item by finding freely licensed media of the same subject, requesting that the copyright holder release this (or similar) media under a free license, or by creating new media yourself (for example, by taking your own photograph of the subject).

If you have uploaded other non-free media, consider checking that you have specified how these media fully satisfy our non-free content criteria. You can find a list of description pages you have edited by clicking on this link. Note that even if you follow steps 1 and 2 above, non-free media which could be replaced by freely licensed alternatives will be deleted 2 days after this notification (7 days if uploaded before 13 July 2006), per the non-free content policy. If you have any questions, please ask them at the Media copyright questions page. Thank you. Whpq (talk) 03:45, 31 December 2018 (UTC)Reply

Help me!

Please help me with...

I uploaded a photo for which I paid an annual copyright license via AP Images - a one-year license for $80.00 USD. How would you advise I upload this photo, indicating that I properly paid for using this photo? Does Wikipedia allow for copyright-paid licenses, and if so, how can I designate this in order to use this photo? I only see options for fair-use it seems. Is it perhaps the case that Wikipedia does not allow/permit copyright-purchased images?

Thank you! Mary

Hi Maidam1, this is a non-free image that you did not create yourself. Uploading an image to Wikimedia Commons requires granting all people in the world the permanent, irrevocable license to use it, even commercially, for free. You did not purchase this right, so this won't work. About non-free images, please see Wikipedia:Non-free content. Thank you   ~ ToBeFree (talk) 14:15, 31 December 2018 (UTC)Reply

I'm not an expert on image copyrights, but let me see if I can get the user who deleted it to help you. We should keep the college picture, but can move it to the college section once the NBA picture is approved for use, assuming it is. Thanks. Rikster2 (talk) 14:09, 31 December 2018 (UTC)Reply

Sounds good; thank you! I agree about keeping the college image and moving it.

Please see above section regarding image copyright ~ ToBeFree (talk) 14:17, 31 December 2018 (UTC)Reply
There is an approved image of Muscala with the Hawks (see link here). If you like, I can put that as the main image and then move the college picture to the college section of the article. Rikster2 (talk) 14:24, 31 December 2018 (UTC)Reply

Thank you! That would be great to make that adjustment. In the meantime, I will see if I can locate a free image of Mike in a Sixers uniform. Appreciate your help! Maidam1 (talk) 14:34, 31 December 2018 (UTC)Reply

A suggestion would be to have Mike get someone from the Sixers organization to take one for this purpose and send it to you. Rikster2 (talk) 14:38, 31 December 2018 (UTC)Reply

Excellent idea! I will make that happen. Thanks again! Mary Maidam1 (talk) 14:51, 31 December 2018 (UTC)Reply

Rikster2 I wanted to chime in about your suggestion that someone take it and "give it to her" as that still wouldn't be acceptable as they'd have to be the one to release it. If Maidam1 takes the photo herself as in clicks the button that takes the photo, she can then upload it as own work and release it. Anyone else doing so will have to release the rights via OTRS. Thank you for the additional info and context. Yes, I understand! Praxidicae.

Hello, Maidam1. You have new messages at Whpq's talk page.
You can remove this notice at any time by removing the {{Talkback}} or {{Tb}} template.

- thank you for your note about uploading images. The image I uploaded yesterday was paid for via AP Images - a one-year license for $80.00 USD. As you noted, I checked fair-use only because I was unable to find an option to designate that my image was copyright licensed. Would you please advise me how I can upload this license imaged, checking off the correct designations at Wikipedia. Sorry, I'm new to this. Is it perhaps the case that Wikipedia does not allow/permit copyright-purchased images?

Thanks! Mary

In one word, "no". Wikipedia does not allow copyrighted images. For more information, please check out Wikipedia:Copyrights#Guidelines for images and other media files. Primefac (talk) 14:32, 31 December 2018 (UTC)Reply

Speedy deletion nomination of File:Mike MUSCALA Sixers.jpg

edit

A tag has been placed on File:Mike MUSCALA Sixers.jpg requesting that it be speedily deleted from Wikipedia. This has been done under section F7 of the criteria for speedy deletion, because it is a non-free file with a clearly invalid licensing tag; or it otherwise fails some part of the non-free content criteria. If you can find a valid tag that expresses why the file can be used under the fair use guidelines, please replace the current tag with that tag. If no such tag exists, please add the {{Non-free fair use}} tag, along with a brief explanation of why this constitutes fair use of the file. If the file has been deleted, you can re-upload it, but please ensure you place the correct tag on it.

If you think this page should not be deleted for this reason, you may contest the nomination by visiting the page and clicking the button labelled "Contest this speedy deletion". This will give you the opportunity to explain why you believe the page should not be deleted. However, be aware that once a page is tagged for speedy deletion, it may be deleted without delay. Please do not remove the speedy deletion tag from the page yourself, but do not hesitate to add information in line with Wikipedia's policies and guidelines. Images from commercial press or photo agencies (Like the AP or Getty Images) are almost never permissible on Wikipedia because they fail the second non-free content criterion. Please read the non-free content guideline before uploading any other images and ask at the media copyright questions page if you are unclear about the copyright status of a work. Thanks, AntiCompositeNumber (talk) 14:39, 31 December 2018 (UTC)Reply
