Captain Beyond

Hello Mark. I've tentatively reverted your recent revisions to Captain Beyond because I couldn't find any news reports, or even any announcement on the official Captain Beyond website, corroborating your claim that the band has been reformed. If you are aware of any such reports or announcements, could you please provide them before reinserting your claims? Please refer to our guideline on identifying reliable sources to see what kind of sources are expected.

I also reverted your update to the image File:Captain Beyond.jpg. This is because you uploaded a different image overtop the old one, which was already in use in the article for the old Captain Beyond album. You're welcome to upload your image again, though please use a different filename for it. Also note that whatever images you contribute here need to be freely licensed, or else accompanied by a statement explaining how Wikipedia's use of the image falls under the fair use provisions. If the image you contributed was a new album cover, then generally speaking it can be used only if the album is a subject of extended discussion in the article it appears in.

Hello, Psychonaut. Bobby Caldwell is re-launching the band and press is in the timelines. He owns all the rights, copy, words and music, print, signature, brand, logo, business, et al. He asked me to update the article because it is incorrect. The article shows that the band has been out of business since 2003 and has a picture of Lee Dorman who has been deceased mor many years now. Therefore, people coming to the page will get wrong informaiton. He also says that their is incorrect information in the body.
I apologize for not signing my edits. My bad. many apologies. I appreciate your help as well. There is no press becasue in our scope of work business schedule we are in the process of putting together a box CD/DVD collection of old and new material as well are planning a tour. So, it is not time to start making annoncments as we have to put the entire business in order - suchas this Wikipedia article. We just want the article to be correcct.

Thanks for the explanation. I'm afraid you've got your order of business backwards, though—Wikipedia is an encyclopedia, which means that it is supposed to report only those facts which have already been published elsewhere. Thank you for your explanation, Psychonaut. I will have our website people post an announcement of the relaunch of Captain Beyond by founder Bobby Caldwell (Allman Brothers, Armageddon, Johnny Winter And, Rick Derringer - Bobby is the drummer on the hit single "Rock and Roll Hootchie Coo").
We are not approaching backwards. I am a donor to Wikipedia. I am a major fan and just want to make sure all articles are correct. I receive many different interpretations and have dialog that shows what one may think among Wikipedia editors with approval authority conflict interpreting guidelines. Needless to say, everyone is trying to do the right thing. We just need to get on the same page and work within the guidelines. I don't think you want the articles to be incorrect? It's not sufficient for articles on Wikipedia to be correct; according to our policy they must be verifiably correct, meaning that claims must be supported by citations to reliable sources. If Captain Beyond has really just reformed, then the present article isn't so much incorrect as it is out of date, just like dozens of other print and online works covering the band which haven't yet heard and confirmed the news. The easiest way to get the reformation mentioned here is for the band to post an announcement on their web page, and for someone (you or me or any other editor) to reference that announcement in the article. If you are really Caldwell's manager then you should be well positioned to expeditiously arrange for such an announcement yourself.

Hi, Psychonaut. I did place my comment on the bottom of the dialog, but the platform spliced it in between. Of course, I mean verifiably correct. For example, the picture of Lee Dorman is verifiably he performing overseas in another band and not under the name Captain Beyond. That makes it verifiably incorrect. The other item is that I do not lie. I own four companies and have many employees. If I say I am Bobby Caldwell's Manager, I am Bobby Caldwell's Manager. Here is his personal cell number: (redacted). Thank you, Phil Knight. I was just making a point to Psychonaut regarding me and my colleagues high regard for Wikipedia as well as our willing transparency. We are not afraid of being contacted for verification, reference citation or anything that we do. We were going to pull the phone number down as soon as the official announcement of the re-launcing of Captain Beyond occurred as demanded by Psychonaut. The soft announcement has already commenced today with the distribution of thousands of flyers at a festival in Costa Mesa, CA USA today. I have concluded the first contract and am waiting on the agreement of my requirements for the rider - again today. I would like to say thank you to you - Mr. Phiil Knight. I would also like to humbly reinforce the collaboration of Wikipedia editors with publishing approvals to please try to be consisten. I have been in contact with Wikipedia officials and they have been extremely supportive. I respect Mr. Psychonaut as well as his zeal and passion. I just ask that the same amount of effort be placed toward consistency throughout. Once I had a Wikipedia approver tell me that a standard for being notable was if the individual gained the position of General Manager of a Professional Sports Franchise. Then I was told by another that they never heard of such a thing. We are involved in a large project and are heavily invested well into seven figures and growing with a long term (planned in advance) journey to re-coup our financial commitment. We are well aware that Wikipedia is "not" a social media site. Nevertheless, the universal public refers to wikipedia numerous time daily as you are better aware of than I. We at Captain Beyond, simply want the article to be current and accurate - veriably. it is important to the people who are named, not named, described, described incorrectly for the article to be verifiably correct and accurate. At this point it is not. I have to believe that those that support Wikipedia as you and I do strive for that accuracy. That is all we want. We have too much time, talent, treasure and many years of blood, sweat, tears and hard work at stake. We have everything to risk. Ergo, if it is an announcement that someone requires (to VERIFY - come to think about it, how about the upload of a deposited check for a large amount - would that be enough for verification?) the re-launch of Captain Beyond - the announcement has already been created, planned within our project timeline and will be executed accordingly. Thanks for your message. To address your points, in order:
  1. I am not singling out the Captain Beyond page. It is one of thousands of other pages on my watchlist.
  2. Bobby Caldwell cannot have copyrights registered with the USPTO, because the USPTO does not register copyrights. However, if he is indeed the rights holder to File:Captain_Beyond_Band_Photo_2015.jpg, then he and not you will need to send confirmation of the licensing terms to the Wikimedia Commons permissions team. I will tag the image as needing permission, and you will be notified of the procedure which Mr. Caldwell needs to follow.
  3. I am not removing File:Captain Beyond.jpg from the Captain Beyond article to harass you; I am doing so because our project's rules generally do not permit non-free images such as this to be used in the article. (Please refer to the non-free content criteria.) If I hadn't removed the image, some other editor certainly would have. You could have Mr. Caldwell release this image under the terms of the CC BY-SA licence, using the same procedure as for the other image, though even then I'm not sure it makes sense to simply substitute the photo of Lee Dorman with the album cover.
  4. In what sense is the photo of Dorman is "unauthorized"? If it's a copyvio I agree it should be removed.

  1. You are singling out me. You are harassing, discriminating and being disrespectful to me. Tell me why I should allow you to do that to me. I am an intellectual property attorney as well as other verticals: USPTO - http://www.uspto.gov/trademark I lecture around the world on such matters. Nevertheless, I will have Mr. Caldwell follow the ever changing (which is good - but not due to you) procedures. At this point, you have a picture up of the deceased Lee Dorman playing a performance with Iron Butterfly. That photo belongs on the Iron Butterfly page and it was taken by someone I do not know with their mobile phone and posted it -with no reference to Captain Beyond. That photo has absolutely nothing to do with the band and quite frankly is embarrassing the lot of them as well as the entire company. I gues you must not like the music. That is your prerogative. But that does not mean you can place a false image on the page that has absolutely nothing to do with band.
  2. The site looks ridiculous to Mr. Caldwell, the band members, me - I am writing music, producing it, performing it in the studio and on stage. I am also funding the whole project.
  3. Wikipedia is a good platform it's participants need to be treated with respect.
  4. OK. You win. I guess that makes you feel rather powerful. May God have mercy upon you.

Mark, I'm sorry that you feel disrespected here; nobody is deliberately trying to make you feel uncomfortable. We encourage participation from everyone, including you, but contributions do need to align with the goals of the project or else they will be removed. You may have overlooked the welcome message posted by SineBot at the top of your talk page, so I'd ask that you follow its link to Welcome to Wikipedia and familiarize yourself with Wikipedia's purpose and principles, as well as the policies and guidelines concerning user behaviour and user-submitted content.
Regarding the specific image licensing issues you mentioned, I can assure you that the rules and procedures have not changed since EugeneZelenko informed you about them back in February of this year. (I see that you were even given a reminder about the permissions procedure the following month by Juggler2005.)
Finally, regarding the photo of Lee Dorman, I still don't understand your contention that it is "unauthorized" or "pirated". As you are an internationally active intellectual property attorney, could you cite the particular Czech law that was violated by the photographer? Psychonaut, thank you for the apology. I appreciate it very much. Now, we move on. I want to and will abide by the rules and procedures of Wikipedia. The main item at issue here is that I am a part of some of the ventures. I cannot help that I am a part of the band Captain Beyond. My role is as Executive Producer/Producer/Guitarist/Pianist/Keyboardist in the recording studio. I am also a songwriting partner of Bobby Caldwell's. In that vein, we write songs together and independently as well as with other artists. How many times have you heard Paul McCartney chafing about the song "Yesterday" listed as written by "Lennon and McCartney" but soley written by him. In addition, none of the other Beatles performed on that recording at all - not in rehearsal, not in experiments, not in recording, nothing. I will also perform with the band. I have my own project The Markie Z Band with '44 Uprising Productions distributed by RouteNote UK and available on itunes, Spotify, Amazon, et al. I am also funding the entire Captain Beyond Project. So, when you direct by saying that I should have influence over sourcing, I do. In due time.

So, be that as it may. You are saying that I cannot post about myself. Even though, I only post the truth. I have reviewed 5 pages that according to your interpretation should be taken down. But, I am not going to bring up those names. As far as the person who took the photo of Lee Dorman, Lee Dorman in Chmelnice club in Prague, in 2010, I know that it was an Iron Butterfly show from a discussion with Bobby Caldwell. Lee told him that someone took the photo while they were playing and posted it up on Wikipedia. I just got off the phone with Wayne Hunnicutt, manager and booking agent of Iron Butterfly who confirmed that statement. We also agreed to promote a combined Captain Beyond - Iron Butterfly Tour - where I will be playing with Captain Beyond and managing them. it is as simple as that, Psychonaut. The picture is irrelevant (to say the least) and a misrepresentation. It is a photo of lee, who I knew back in the '70's, that is an Iron Butterfly photo. Lee deserves his due credit, God Bless him. He has his own Wikipedia page and that is where that photo should reside - properly and accurately. The photo that is on his page is accurate and at a different club in the Czech Republic. The photo on the Captain Beyond page should be taken off and correctly uploaded to his Lee Dorman page and to the Iron Butterfly page. But it is inaccurate to reside on the Captain Beyond page. I will be that you have a lot of people coming at you with all sorts of things. I respect your volunteer work for such a good cause as Wikipedia. I am a person that fights insatiably for the truth. That simple. What I state in verbal or written form is true - always. You are Psychonaut, so I do not know your beliefs. I respect you and your beliefs. I would never impose my beliefs on you. One thing that I live by and strongly believe in "is that everything that is said and written is heard and seen immediately." "I also believe that what one does to another, one does to themselves." If you ever abandon your legal threats and come back, it may be helpful if you explain why you linked to the USPTO Trademark page in discussion about copyright of a photo. As an "intellectual property attorney" who lectures "around the world on such matters", I'm sure you're well aware of the difference between copyright and trademark, so I'm sure you'll also understand our confusion as experienced lay people when you linked to the seemingly irrelevant site, after previously suggesting that copyrights were registered with the USPTO which as I'm sure you're aware, they are not.
