Can you provide some evidence that this picture was released for promotional purposes? The copyright and terms of use of Sony websites explicitly prevents the image from being used as you have stated but presumably you found an agreement different to [1]. Your change to Image:Shakira_05.jpg still asserts that the image is a promotional picture from a press kit. I can find no such evidence that this is true, and it seems to contradict the source you are claiming. Furthermore, Sony's terms of use explicitly forbid using it as you are doing.
