Artistic craftsmanship

"If a work is not a sculpture, it may still qualify for copyright protection as a work of artistic craftsmanship. The types of product that may fall into this category include "handicrafted jewellery tiles, pots, stained-glass windows, wrought-iron gates, hand-knitted jumpers, and crocheted doilies" (Bentley and Sherman summarising the case law in Intellectual Property Law (Second Edition) p74)."

So the onus is upon you to determine whether a sports trophy that belongs to a league that I provide media for would be classified under "Artistic craftsmanship" and furthermore would a court adjudge this sports trophy "artistic" (which is required before awarding any separate protection). Then and only then can you accurately make your allegation, until then you haven't any premise to make such allegation.

Thank you for responding

I've had another look at the image you mentioned on my talk-page, based on your analysis, the PUF concern was withdrawn, and the image has now been tagged as a potentially useful image for Wikimedia Commons. It was challenged because it wasn't clear from the file description page, who the creator of the trophy was, compared to the creator of the photo, the trophy being a seperate artistic work. However, given the new information in your response, that concern is now irrelevant, as it's reasonable to assume that as you've created media for the holders of it, that you had permission to do so. The PUF concern accordingly has been withdrawn.

I've also taken another look at a second image which you had uploaded File:Joan McKowen.jpg again on the basis of the information you provided in response to the concern raised in the PUF disscussion. Was this a photograph you took? (if so do you have a higher quality version, compared to the currently web sourced one?) Sfan00 IMG (talk) 11:35, 13 September 2015 (UTC)

The second image is of a deceased person whom is the key subject within the article it has been used in as the trophy is a memorial for her as a person.

Under the Non-Free use definitions on Wikipedia, the image must meet all 10 definitions, which it does: https://en.wikipedia.org/wiki/Wikipedia:Non-free_content#Policy_2

The issue is that I tagged it as Public Domain when it should be Non-Free fair use instead.

Ah OK, I wasn't sure she met the criteria so I didn't make an article for her, yes she was absolutely pivotal to the development of women's ice hockey in Australia at a national level and was instrumental in the current formation of the National Women's ice hockey league here. As well as international she was one of the most key figures in Australian women's hockey being represented internationally. I will save the information for an article about her though :).

If it's a 1922 image, why is the archive claiming a new copyright? Wikipedia policy generally seems to be that if the original was PD by 1996 (which for a 1922 image it would be) then mere mechanical reproduction doesn't generate a new copyright. I appreciate Australia may have a different 'sweat of the brow' doctrine to the US.

I sourced that image directly off of a person who has claimed copyright on the image. To be safe I did seek his permission to use the image, which he granted.

According to Australian Copyright Law however, there is no grey area with photographs (something I only recently found out a week ago).

It appears to me that he cannot actually claim copyright on the scan he made of the original 1922 image, and the scan itself cannot be considered 'new work' which could fall under new copyright. I agree that this image should actually be listed as Public Domain. I'm happy to credit him for finding it but Australian law is very clear that he cannot claim copyright on the image. More references are being added now anyway, so it will be satisfactory shortly. Each finals series usually averages a minimum of 3 references as they are a 3 game series so you at least get 1 newspaper article with a game report per game until at least the 1940's from what I have collected. All are major circulation newspaper articles so the quality of the source is undeniable. I try to stick with those references for this sort of thingOrion 2012 (talk) 04:44, 22 October 2015 (UTC)

Archiving references

Hey, not sure if you noticed but Ontheflyhockey.com recently shut down resulting in the loss of some very useful information on Australian ice hockey. With this in mind you may be interested in using WebCite to archive any sources you have added to the articles. It really helps tackle the volatility of websites, especially in the case of Ontheflyhockey.com which was shut down without any known backup. Salavat (talk) 05:53, 31 October 2015 (UTC)

This is an article is about a brand new ice hockey team that has just been formed (and will continue to compete) in Australia's national Junior hockey league. This is significant and I ask that you remove the speedy deletion tag immediately. It is of national significance to Australian sport and in particular the national junior ice hockey league. Hi, I appreciate your concern over a 'rights issue'. As already indicated, I work in a volunteer capacity for the actual entity that owns the rights to this image - as the entity itself is a volunteer organisation, this is as high a capacity I can attain for the work I do. I am the administrator for the entities social media and online activity. I find it impossible to further evidence that I have the right to use this image as that would only come from somebody like me or it would be me who grants myself the right to use the image. Feel free to do what you wish, Wikipedia would lose out on the opportunity to collect an image of a historic national trophy (we have used on other online platforms already) should you wish to delete the file. I just happened to see your comments on the deletion discussion. Since the discussions had already closed, no one saw your comments. (As the page says, subsequent comments should be made elsewhere.) But to reply, because Wikipedia's servers are physically located in the United States, Wikipedia is obligated to follow United States copyright law. See Wikipedia:Copyrights#Governing copyright law. Thank you for your response. I appreciate the approach to this though I feel it is more nuanced than this (ie. if you look at the definition of what "derivative work" is and how copyright is managed and who possesses copyright status in the case of derivative work - which brings the 'USA based server location' reasoning into question), however I have simply sought a more practical source for sharing these images as this is proving to be a crippling limitation of Wikipedia if international participation is being encouraged yet only if it complies with American Copyright Law using server location as the explanation for why this is. That is a shame in my opinion but hopefully one day Wikipedia owners can negotiate a way forward from this limitationOrion 2012 (talk) 01:59, 25 April 2020 (UTC)
