Smoking ban

Hi. I removed your recent addition to the Smoking ban article, but you might want to re-add it in a more appropriate place. The problem was it was a legal definition, and by nature very specific, which may not apply to legislation in other parts of the world. It probably more properly belongs in the UK section of the Smoking bans by country article (and possibly only in England?). Thanks. --Escape Orbit ^(Talk) 12:26, 28 October 2008 (UTC)

It's on a bill presented to the House of Commons that defined legislation, how more legal can you get? But the exact nature of it is irrelevant. How does it apply to the smoking ban in, say, Arizona? Every place with a smoking ban of some sort will have some precise definition of what exactly constitutes 'smoking', and the definition you added is simply the one defined for England & Wales. Yes, what about Arizona? Do you have a link where I can read the definition? I am convinced that smoking bans don't prohibit smoking. If they would prohibit smoking, you would be allowed to keep a lit cigarette in your hand as long as you don't bring it to your mouth and suck it. Therefore, for example the smoking bans in Germany define that their aim is preventing second-hand smoke (and nothing else). --Plenz (talk) 04:25, 29 October 2008 (UTC)

I just stumbled over User_talk:Rockdowner. I agree totally and my above mentioned contributions go in the same direction: smoking bans are not made against smoking (= consumption of tobacco), they are made against smoke (= prevent harm from other people). I finally found something about Arizona:

11. "Smoking" means inhaling, exhaling, burning, or carrying or possessing any lighted tobacco product, including cigars, cigarettes, pipe tobacco and any other lighted tobacco product. [1]

So this law means exactly the same as the English legislation. I think, now it's your turn to show any law which prohibits smoking without the aim to prevent second hand smoke. --Plenz (talk) 13:16, 30 October 2008 (UTC)
