I have found no indication that Eberson ever claimed a copyright in his blueprints, plans and specifications, or in his architectural designs. There is evidence that he was frustrated that other architects, contractors, and theatre owners copied his atmospheric design, but there is no record of any copyright claim. There is evidence that a competitor stole actual Eberson plans from his office, but Eberson did not bring any litigation as a result of that. In fact, hundreds of atmospheric theatres were designed by other architects. The Eberson family, through my conversation with a grandson, has no record of any copyright. It is also extremely unlikely that Eberson, who copied many architectural works from Europe for use in his theatre design, would have considered the building design protected. File permission problem with File:Caproni.jpeg
editThanks for uploading File:Caproni.jpeg, which you've attributed to http://www.giustgallery.com/images/pdfs/1911-caproni-catalog.pdf. Statue may be PD, but what is the copyright status of the photograph?. I noticed that while you provided a valid copyright licensing tag, there is no proof that the creator of the file has agreed to release it under the given license.
If you are the copyright holder for this media entirely yourself but have previously published it elsewhere (especially online), please either
- make a note permitting reuse under the CC-BY-SA or another acceptable free license (see this list) at the site of the original publication; or
- Send an email from an address associated with the original publication to permissions-en@wikimedia.org, stating your ownership of the material and your intention to publish it under a free license. You can find a sample permission letter here. If you take this step, add {{OTRS pending}} to the file description page to prevent premature deletion.

This image was reproduced by making a scan from a page in the Caproni 1911 catalog. The Caproni company is no longer in business.
