However, I think that the way it is being used fails the first non-free content criterion. I have a connection to him in the regard that I have received permission from him to use the image of himself. Nowhere does he fall under any of the criteria you had listed above. Good thing this isn't Wikimedia either so I don't have anything to do with the compensation you speak of...
